These Terms of Use constitute a legal agreement (“Terms”) between “You” (the Registered User) and Geri Care Health Services Private Limited (formerly known as Geri Home Care Service Private Limited) (hereafter referred to as “We”, “Us”, “Our” or “Company”) in connection with Your visit, access and/ or use of our website www.gericare.in (the “Website”). Please read these Terms carefully before accessing or using the services offered through the Website. If You do not agree to all or any of these Terms, then You may not access, download, register with or use the Services offered through it.
Geri Care Health Services Private Limited (formerly known as Geri Home Care Service Private Limited) (“Company”) is a private limited company, having its registered office at Old No.8, New No.21 First Avenue, Indira Nagar, Adyar Chennai, Tamil Nadu 600020 India. The Company offers a variety of healthcare services for senior citizens, ensuring comprehensive and effective healthcare for senior citizens including but not limited to doctor consultations, diagnostic services, physiotherapy and nursing services, pharmaceutical products, ambulance and emergency medical services, and hospital interventions through its own multispecialty hospitals.
The Website is designed to provide information about the healthcare and related services provided by the Company from its various Geriatric Multi-speciality Hospitals, Assisted Living Centres, Geriatric Clinics, Diagnostic Labs, Physiotherapy, Mind & Memory Centres, and Home Care Division. The Website also facilitate the Registered Users in booking appointments with Medical Practitioners for physical and tele consultations and provide all information in availing a range of services skilled nursing, Day Care services, Physiotherapy services, Nutrition & Dietary Advice to its patients, providing trained caregivers to look after elderly patients whether in their home or at our Assisted Living centres for Rehabilitation, Respite Care, Post Trauma Care, Post Hospitalisation Recovery, Palliative care and Specialised services for patients with Dementia etc. Additionally, the Website also processes payments for patients (the “Services”).Please note that all Services and products displayed on the Website may not be available all Geri Care establishments and at/from all locations. The Company reserves the right to withdraw or modify Services and products at its sole discretion. While We exercise all reasonable care and diligence to provide the Services available for booking through the Website, it is possible that due to circumstances beyond our control, these Services may not be delivered, may be partially delivered, or may be delivered outside the specified timelines.
The Agreement supersedes all previous (if any) oral and written terms and conditions of use of the Website communicated to You.
Definitions
“Medical Practitioners” are individual doctors/geriatricians or doctors associated with GeriCare medical establishments, i.e GeriCare Clinics, GeriCare Assisted Living Centres, Geriatric Hospitals, Pharmacies, Diagnostic Labs etc. whom the Company has employed or set up or has collaborated with and who are listed on the Website to provide services to its Registered Users. - “Registered User” means an individual who is either a Patient or their family member, and who creates an account on the Website by providing the patient’s personal information such as name of patient, phone number, and email address to accesses the Website to avail specialized healthcare services provided by the Company, on behalf of the patients.
- “Patient” means a senior citizen or elderly person, who is in need of medical or healthcare services, including consultations, treatments, diagnostic procedures, or other forms of care from healthcare providers such as Medical Practitioners, nurses, specialists, or allied healthcare professionals.
The Website is an integrated system, developed and operated by the Company, to enhance the efficiency and effectiveness of healthcare services delivery by the Company to the elderly. The key features of the Website include:
- (i) Service Booking: The Company enables Registered User to book various healthcare services required by Patients, ensuring timely and organized care delivery as listed on the Website.
- (ii) Booking Consultations with Medical Practitioners: The Website enables Registered Users to book consultations appointment with Medical Practitioners through the Website and also enables the Registered Users to directly connect with a Medical Practitioners through value added telephonic services. The Registered User understands that if a Registered User books a telephonic consultation, the Company reserves the right to share information pertaining to a Registered User and a Patient with the Medical Practitioner and also store such information for future uses of the Services
- Payment Processing: Our Website allows the Registered Users to process payments securely and efficiently through a third party payment gateway syetems, providing a seamless financial transaction experience for both the Registered User as well as the Company.
- You agree to use the Website solely for purposes and to avail services for Patients in compliance with all applicable laws. You shall not utilize this Website or any of its Services for any purposes outside the scope intended under these Terms.
- You understand that in order to register as a Registered User on the Website, you may be required to provide information such as Patient name, email address, phone number, description of the Services sought and other relevant information sought by us to enable us to provide Services (“Patient Information”). If a Registered User is not a Patient, then we will also collect such users name, address, phone number and such other information as we consider necessary for Patient well being and care.
- You agree to maintain and promptly update the User as well as Patient Information you provide to the Website and keep all such information accurate, current, and complete. All booking and payment related information will be sent to the Registered User through the email address and the mobile number provided to Us. We shall not be responsible for any loss or inconvenience caused due to your non-updation of your User Information on the Website.
- You acknowledge that once you create your account on the Website, You are the sole authorized user of such account. You must treat information such as username, password, any other piece of information as part of Our security procedures as confidential and must not disclose it to any other person. You are solely and fully responsible for all activities that occur under Your account. You agree to notify Us immediately of any unauthorized access to or use of your account or any other breach of security.
- You must be 18 years of age or older to register as the Registered User on the Website to use the Services, or visit or use the Website in any manner. By registering, visiting and using the Website or accepting this Terms, you represent and warrant to Us that you are 18 years of age or older, and that you have the right, authority and capacity to use the Website and the Services available through the Website, and agree to and abide by these Terms.
- We encourage You to independently verify any information You see on the Website.
- The Company does not recommend or endorse any Medical Practitioner or specialists mentioned on the Website.
- By using and/or registering yourself on the Website, You authorize us to contact you via email or phone call or SMS or through any other Internet / mobile telephony based applications and offer You additional service, imparting service knowledge, offer promotional offers run by the Company and its affiliates directly or through its associates, agents, vendors and partners
- You agree to abide by the advice provided by the Medical Practitioner including any immediate need for admission to a hospital. If You fail to adhere to the advice, you are solely responsible for the outcome of such failure to adhere to the advice.
- You shall declare to the Company or the Medical Practitioner any alternative treatments or medications being administered to the Patient at the outset or even during the course of receiving healthcare from the Company. You understand that any omission to do so could adversely affect the quality of care provided to the Patient and You will not hold the Company responsible for the consequences.
The Website provides You the ability to pay online through a third-party payment gateway for the Services shown on the Website. When You choose to pay online, You may be directed to a third-party payment gateway to enable the processing of the payment for the Services You avail. This transaction will be governed by the terms and conditions and privacy policy of the third-party payment gateway. The Company shall not be liable for any loss or damage arising directly or indirectly arising out of the usage, decline, or acceptance of authorization for any transaction, for any reason whatsoever.
INTELLECTUAL PROPERTY RIGHTS- All intellectual property rights in and to the Website, including but not limited to text, graphics, logos, button icons, images, audio clips, software, processes, techniques, trademarks, and any content provided or generated through the Website, belong exclusively to the Company.
- You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the content and materials on the Website strictly for non-commercial use related to the services provided by the Company. You agree not to reproduce, modify, distribute, display, mirror, frame, republish, download, transmit, or create derivative works of the Website or any content within it, in whole or in part, without prior express permission of the Company.
- You understand that You are the owner of all rights (including all intellectual property rights) in the content that You provide through the Website including but not limited to the reviews, feedbacks or testimonial provide to the Company (“User Content”). You hereby grant the a perpetual, non-revocable, worldwide, royalty-free license to make use of such User Content including the right to copy, distribute, display, reproduce, adapt, the User Content as the case may be, and create derivate works of the User Content, as the case may be in the manner set out in our Privacy Policy

- All User Information and Patient Information You submit is truthful and accurate and that You agree to maintain the accuracy of such information;
- You as a Registered User will use the Website solely for non-commercial use.
- You will not engage in any form of antisocial, disrupting, or destructive acts, including "flaming", "spamming", "flooding", "trolling", "phishing" and "griefing" as those terms are commonly understood and used on the Internet.
You shall not engage in any of the following activities while using the Website:

- Infringe upon the intellectual property rights of the Company or any other user of the Website.

You shall ensure full compliance with all applicable laws, regulations, and international standards, including those under the Information Technology Act, 2000, and its amendments, while using the Website and availing its services.
DISCLAIMERS
- The Company makes no warranty or representation that any errors in the Website will be corrected except as required by law.
- The Website is provided on a "as is" and "as available" basis. Neither the Company nor its directors, employees, officers, directors, agents makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the contents, information, or third-party links made available on the Website.
- All interactions, communications or transactions, between you and other users on the Website are separate transactions. The Company does not control such information and plays no determinative role in the finalization of these interactions. Therefore, the Company disclaims any liability for the outcomes of such communication or interaction or transactions.
- The Company shall not be held responsible if You fail to give correct medical Patient Information to a Medical Practitioner and consequently the outcome of such failure.
- The Company does not make any representations or warranties with respect to any Medical Practitioner apart from their qualifications to practice medicine under laws applicable to medical practitioners in India.
- The Company may not offer certain services through certain modes of delivery and as such all services may not be available from all channels or from all establishments or at all its locations. While the Company shall take all reasonable measures to update such information in the Website, It is the sole responsibility to ascertain what services are available when you require the service from our Call centre or through email address to the Contact person named in this Terms of Use.
CANCELLATION & REFUNDS
- In the event of Cancellation of an appointment or request for supply of any product, by the User / Booker, of any service, the Company, at its sole discretion, may agree to accept such Cancellation and reserves the right to Charge a Cancellation Fee.
- The Cancellation fee of 15% of the Price / Rate of the Cancelled Service / Product shall be charged on the User / Booker. The Company, at its sole discretion, may waive off the Cancellation Fee, either partially or in full.
- No refund of payments shall be made by the Company and or its affliates, agents, partners etc, in the event of Cancelletion by the User / Booker. of any Pre booked service or order for supply of goods (medicines, consumables, equipment, devices etc), except in the event of non availability of such service or goods beyond reasonable time. In such cases of cancellation, the Company, shall, at its sole discretion, agree to refund the payment already made by the user / Booker, subject to deduction of Administration Charges of 15% of the Value of the payment and deduction of 100% of the value of cess, levies and taxes, if any, that might have been charged or may be applicable.
- Refunds shall be made by the Company within reasonable time wbich may vary according to the situation and is case specific.
- No Refunds shall be made in Cash. Refunds shall be made through direct electronic / on line / UPI transfer to the bank account of the payee only. No Refunds shall be made to any person or entity other than the payee, except in the case of death or disability of the Payee, in which the claimant shall furnish all proof of eligibility, as may be sought by the Company, at its sole discretion, to satisfy itself of the Bona-fides of the claimant, to receive the refund. The Company has the right to refuse refund whenever the Bona Fides is deemed insuffeciant, by the Company.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no event will the Company or its affiliates be liable for any direct, indirect, special, incidental, punitive, exemplary or consequential damages (including, without limitation, loss of business, revenue, profits, goodwill), whether or not the Company has been warned of the possibility of such damages or could have reasonably foreseen such damages. Notwithstanding anything to the contrary in these Terms, the Company’s liability under these Terms to You shall in no event exceed the fee amounts collected from You for the consultation with the Medical Practitioner or for any other services availed on the Website or INR 5000 whichever is lower.
INDEMNITY
You agree to indemnify and hold harmless the Company, as well as each of its representatives, employees, contractors, agents, officers, directors, shareholders, affiliates and assigns from all liabilities, claims, damages, costs and expenses, including reasonable attorneys' fees and expenses in relation to all claims arising out of:
- a breach of the representation and warranties under these Terms;
- use or misuse by the content available on the Website for any other purpose other than those under this Terms; or
- breach of any intellectual property or other proprietary rights of any person or entity.
CHOICE OF LAW
These Terms shall be governed by the laws of Republic of India without giving effect to its conflict of law provisions. These Terms shall be subject to the exclusive jurisdiction of the courts at Chennai, India.
SEVERABILITY
If for any reason a court of competent jurisdiction finds any provision or portion of these Terms to be unenforceable, the remainder of these Terms will continue in full force and effect.
